Two Big Supreme Court Decisions
The U. S. Supreme Court ruled on two significant criminal cases today the first related to sexual offenders, the second case related to minors convicted of serious crimes.
The Supreme Court has decided that those individuals convicted of a crime sexual in nature, can be held indefinitely after their time has been served if the federal government believes they are "sexually dangerous." The case U.S. v. Comstock 08-1224 was a challenge to part of the Adam Walsh Child Protection and Safety Act. The Act named after "America's Most Wanted" television host John Walsh's son Adam was signed into law in 2006. What is also interesting is that two of the more conservative Justices ruled against the decision. Justice Thomas and Scalia noted that nothing in the Constitution allows Congress the power to commit a sexual dangerous person.
The second case related to minors convicted of majors crimes other than murder. The Court has held that minors convicted of serious crimes cannot be sentenced to life in prison without parole. The 5-4 ruling by the Court says that the U.S. Constitution (8th Amendment) requires that young people serving life sentences must at least be considered for release.
